Crown Publishing, a division of Random House, has announced a second printing of the second edition of The Tyranny of Good Intentions, and the noted civil libertarian and defense attorney, Harvey Silverglate, has just published a book covering many of the same legal cases and vetting our conclusion that in the United States every American is in grave danger from unscrupulous prosecutors who target the innocent.

The U.S. Constitution Never Had a Chance / Politics / US Politics
An eminent North Carolina jurist, with whom I served on a Criminal Code Revision Commission, once told me that the law is what the last court that looks at it says it is and even then, its Justices usually disagree. I told him that there must be something very wrong with such a system. Thinking about this issue and attempting to isolate the arguments in Supreme Court decisions for use in my logic classes over decades, I came to the conclusion that so many things were wrong that even selecting the most egregious would be difficult. Perhaps that is why I have not attempted to write this piece until now.

All intelligent political analysts have known since Ancient Greece that the Tyrannical State always arrives on gentle cat's paws, as Plato and others put it a few centuries after the basic strategies and tactics of Building The Secret Tyrannical State had been used so effectively by Peisistratus to build the first full-blown tyranny in Athens [though some objected that Solon's "new deal for all" was a tyranny]. The Tyrant always arrives as the Great Friend of the People promising them new freedoms and a vast cornucopia of free goodies. Peisistratus was lucky enough to have new loads of silver to mint real coins to buy the submission of the masses for a while, expand trade and prosperity. Most states in the modern world use the Miracle Cures of Paper Money and the Central Planning of Finance, as has been done in the U.S. to a stunning extreme by the Fed and the Big Banks working under that vast government umbrella of guaranteed free money for them.

Things seem to be unraveling quickly for the new administration. The latest unemployment numbers are worse than the last reports. For all the billions of dollars spent and committed to fixing our economic problems, the situation is only getting worse. This was to be expected by those who understand the root causes of the problems. Throwing money around and creating more government programs is both simplistic and damaging to the economy.

Only the Congress has the authority to control interstate commerce under the Constitution. It has been an interesting week indeed for the Federal Reserve. Early this week, it was announced that President Obama intends to reappoint Fed Chairman Ben Bernanke to a second term in January, signaling a vote of confidence in him. Bernanke seems to be popular with the administration and with Wall Street, and with good reason. His lending policies have left big banks flush with newly created cash that covers up old mistakes and allows for new ones.

My Portrait/Caricature of the Late Senator Edward Kennedy / Politics / US Politics
30 years ago, in 1979, I was asked by the Economist magazine to do a caricature-portrait of Ted Kennedy for their cover, because he was then seen as a serious challenger to President Jimmy Carter. The caricature-portrait wasn't used by the Economist in the end, because they decided that another story was more important for the cover at the time (such is the fate of artists who are commissioned by magazines!)
